YALANCI ŞÂHİTLİK
Değerli Müslümanlar!
Dinimizin yasakladığı büyük günahlardan biri de, yalancı şâhitliktir. Allah’a ve ahiret gününe inanan bir kimsenin, hatır ya da çıkar için hâkimin huzurunda yalancı şâhitlik yaparak haklıyı haksız, haksızı haklı çıkarmaya çalışması, büyük bir vebaldir. Çünkü yalancı şâhitlik, Allah’a şirk koşmadan sonra gelen, büyük günahlardan birisidir.
Yüce Allah Nisa sûresinin 135. âyetinde meâlen şöyle buyurur: “Ey iman edenler! Adaleti, titizlikle ayakta tutan, kendiniz, ana-babanız ve akrabanız aleyhinde de olsa, Allah için şâhitlik eden kimseler olun. (Haklarında şâhitlik ettikleriniz) zengin olsunlar, fakir olsunlar Allah onlara (sizden) daha yakındır. Hislerinize uyup adâletten sapmayın, (şâhitliği) eğip, büker (doğru şâhitlik etmez), yahut şâhitlik etmekten kaçınırsanız (biliniz ki) Allah, yaptıklarınızdan haberdardır.” [1]
Sevgili Peygamberimiz, bir gün ashâbına büyük günahları anlatırken, bunların, Allah’a şirk koşmak, haksız yere insan öldürmek, ana-babaya âsi olmak ve yalancı şâhitlik yapmak olduğunu söylemişlerdir.[2]
Peygamberimiz, yalancı şâhitliğin ne kadar büyük bir günah olduğunu anlatmak için, dayandığı yerden doğrulup dizlerinin üzerine gelerek; onu birkaç kez tekrarlamış ve hiddetinden mübarek yüzü kızarmıştı. Diğer bir Hadis-i Şeriflerinde de; “Şâhitlik için çağırıldığı halde, bildiğini gizleyerek şâhitlikten kaçınan kimse, yalancı şâhitlik yapmış gibidir.” [3] buyurmuşlardır.
Aziz Cemaat!
Yalancı şâhitlik yapan, her şeyden önce kendine zulmetmiş, ve en büyük kötülüğü yapmıştır. Çünkü başkasının dünyası için kendi ahiretini, ebedî mutluluk yurdunu satarak cehennemi satın almıştır. Bunun yanında, haklı çıkarmak için şâhitlik yaptığı kimseye de kötülük yapmıştır. Çünkü haksıza yardım etmiş, onu haklı göstermiş ve aleyhine yalancı şâhitlik yaptığı masum kimseye de zulmetmiştir. Onun hakkını başkasına çiğnetmiş, hakkının zâyi olmasına yol açmış, onu herkesin nazarında haksız duruma düşürmüş, ayrıca mahkemeyi de yanıltmıştır.
Bakınız; Sevgili Peygamberimiz, bu konu ile ilgili ne buyuruyor:
“Ben de bir insanım. Sizler, aranızdaki anlaşmazlıkları bana getirmektesiniz. Olabilir ki, biriniz delillerini diğerinden daha iyi arz eder, ben de ondan işittiğim şekilde hükmedebilirim. Bu şekilde kime kardeşinin hakkını vermişsem, ona ateşten bir parça vermiş olurum.” [4]
Yalancı şâhitler; adaleti engelledikleri için toplumda kimsenin değer vermediği kişilerdir. Söyledikleri en doğru sözler dahi, şüphe ile karşılanır. Bunlar, dünyada sefaletten, ahirette de Allah’ın azabından kurtulamazlar.
Yalancı şâhitliğin keffareti yoktur. Yalnız tevbe etmekle de bunun vebâlinden kurtulmak kolay değildir. Çünkü bu, bir kul hakkıdır ve bu hakkı ihlâl eden kişi, ancak mağdûr ettiği tarafın zararını telâfî ederek, helâllik isteyip gönlünü aldıktan ve bir daha yapmamak üzere tevbe edip Allah’dan af diledikten sonra affını ümit edebilir. Mü’min, acı da olsa gerçeği söyleyen ve kendi aleyhine bile olsa hakikat ve adaletten ayrılmayan insandır.

Uno de los mayores pecados prohibido por nuestra religión, şâhitliktir falsa. Una persona que cree en Alá y en el Último Día, en aras de intereses, o al hacer falso testimonio en presencia del juez tiene razón, injusto, mal, para justificar el trabajo, un alto precio a pagar grandes. Debido a que el falso testimonio, después de ejecutar el circo de Dios, es uno de los pecados mayores.
135 Dios Todopoderoso Sura Nisa meâlen versículo dice: "¡Creyentes! Justicia, defender con firmeza, a ti mismo, aunque sea en contra de los padres y familiares, ser testigos de Dios. (¿A quién usted es testigo de que) sea rico, pobre, no les importa a Dios (que) está más cerca. Ya sea que sus sentimientos se desvían de la justicia, (testimonio), doble, doble (no declarar), o son testigos de evitar el Allah (saber que) está bien informado de lo que hacéis ". [1]
